Man charged in ATV-related death appears in court

MARSHALL — Cory Lee Buchert, 30, of Russell, the man charged in the September death of Nichole Rathje, 27, of Marshall appeared in Lyon County District Court on Monday.

Buchert is charged with manslaughter in the second degree and two counts of criminal vehicular homicide. Buchert was driving an all-terrain vehicle while impaired and in an accident which injured Rathje on Sept. 3 in Lyon County, the complaint alleges.

Buchert did not call an ambulance or seek medical help for Rathje after two ATV accidents, the complaint alleges. Buchert placed her on the back of the ATV after the first accident where she was injured and then while driving the ATV, Buchert was in a second accident, the complaint alleges.

Buchert again placed Rathje on the back of the ATV and when the ATV quit, he dragged Rathje and left her outside of his house in Russell for several hours while he showered, washed clothes and slept, the complaint alleges. Buchert woke up and found Rathje dead outside his house several hours later, the complaint alleges.

Buchert said to law enforcement he thought Rathje would be OK and that they talked outside his house before he went inside, the complaint alleges.

In court on Monday, Buchert and his lawyer Jim Flemming requested a pre-trial hearing to be held before an omnibus hearing. Buchert waived his court time line.

A pre-trial hearing was set for April 25.

Buchert is the third person to be charged with criminal vehicular homicide in less than a month in Lyon County. Olga Franco, also known as Alianiss N. Morales, 23, of Minneota, was charged with four counts of criminal vehicular homicide in the death of four Lakeview School students killed in a Feb. 19 school bus crash. Franco drove a van which struck the bus and she did not stop for a stop sign, the complaint alleges.

Franco did not have a license and is an illegal immigrant from Guatemala, Immigration and Customs Exchange officials have said.

David Christopher Breyfogle, 32, of Taunton was charged with two counts of criminal vehicular homicide and one count of driving after cancelation-inimical to public safety in the Feb. 29 hit-and-run death of Norma Traen, 72, of Taunton.

Breyfogle was driving with a canceled driver’s license and struck Traen, who was walking along Lyon County Road 1, and Breyfogle did not stop or report the crash, the complaint alleges.

The complaint for Breyfogle also alleges he was impaired with alcohol.

Much of the island of Kauai is uninhabited and wild, making it perfect for exploring from the back of an All-Terrain Vehicle. Some of the destinations included on the various tours include former sugar cane plantations, rain forests with secluded waterfalls, working cattle ranches and points along beautiful valleys. Generally speaking, the tours last several hours and include a meal or snacks in the price of the ticket.


You’re likely to get muddy - this is the wettest Hawaiian island, after all - so dress appropriately. And because your hands will be preoccupied with driving the vehicle, you’re probably not going to be able to be snapping photos along the way. Check with the tour companies before you leave - many will take digital photos during your tour which you can buy at the end of the trip.

A couple of the ATV tour companies on Kauai are Kauai ATV and Kipu Ranch Adventures, and this growing trend should see even more companies offering ATV tours in the near future.

Please note: ATV tours are not advised for pregnant women or people who have back problems. You must be age 16 or over to operate an ATV, and you must be over the age of 5 to be a passenger in one of the multi-person dune buggies.

The ATV driver killed in an accident Monday in Coal City has been identified as James Douglas Walz, 19, of Coal City.

A 13-year-old passenger on the ATV remained in critical condition at Charleston Area Medical Center, Raleigh County Sheriff’s Capt. Gordon Gregory said.

The two were riding on a Honda ATV on Coal City Road about 5:25 p.m. Monday when the driver exited the roadway, lost control of the vehicle and struck a utility pole. Both riders were ejected from the ATV. The vehicle came to rest when it struck a parked U-Haul truck.

Wisconsin DNR Secretary Matt Frank is recommending against the development of ANY ATV trails in the Northern Highland-American Legion State Forest.

In a memo to the Natural Resources Board released this afternoon, Frank said his reasons included:

? the negative impact ATV trails would have on many of the 2 million nonmotorized NH-AL visitors every year,

? the “very strong opposition to ATVs on public land,” particularly in Vilas County,

? “the potential for adverse ecological impact” from ATV trail development,

? and the high cost of ATV trail development, on-going maintenence and law enforcement.

Frank’s recommendation comes in advance of the April 23 meeting of the Natural Resources Board (NRB), at which a final decision will be made whether to permit ATV trails in the NH-AL.

The Frank memo is an excellent sign that common sense and good public land management will prevail. And the recommendation was not unexpected by anyone that read Frank’s February memo, discussed here.

No one should assume, however, that the NRB will agree with Frank and vote to prohibit ATVs in the NH-AL. Chances are they will, but I, for one, won’t plan to attend any parties until after the votes are cast and counted.

As stated in an email by Sue Drum, a leading opponent of ATVs in the NH-AL, “Now we need people, more than ever, to come to Madison for the April 23 meeting to show the NRB that this recommendation has many supporters. When we are winning, it is not the time to pull back.”

In order to speak at the meeting on the 23rd, you must call NRB liasion Laurie Ross at 608/267-7420 by this Friday, April 18, at 4 p.m. Testimony will likely begin at 1:15 p.m., according to the NRB meeting agenda.

DNR against new ATV trails in Northern Highland-Am

Department of Natural Resources officials plan to present their recommendations for new all-terrain vehicle trails in northern Wisconsin next week.

And that recommendation is that new ATV trails should not be constructed in the Northern Highland-American Legion State Forest.

The DNR has been studying potential new ATV trails that would run through Vilas, Oneida and Iron counties for more than two years.

After hundreds of hours of research and thousands of letters from area residents, DNR officials say the plan doesn't provide a cost-effective trail development plan that is sustainable and meets rider expectations. Researchers say they also faced opposition from residents and many ecological concerns.

The DNR will present their recommendations to the Natural Resources Board on Wednesday. The board will then make the decision whether or not to go ahead with construction of the trails.

Food plots have changed the way deer hunters hunt deer. Twenty years ago, most placed a stand over a runway or scrape line and waited for a buck to walk in. Things have changed now deer hunters are putting in food plots. Thousands of outdoorsmen are purchasing ATV’s, plot machines, and tilling the ground, putting down lime, planting clover, brassicas, and a variety of seed blends with one goal in mind: bringing in deer from miles around that can’t resist the taste and nutrition a food plot provides.

Over the years, food plots have become a game for the rich. Have you looked at the price of a bag of food plot seed lately? Putting in a plot practically requires mortgaging your house a second time. Have you looked at the cost of a plot machine? Most plot machines cost a thousand dollars and up. If you throw in the cost of a new ATV that can cost up to ten thousand dollars, you can see how putting in food plots can be out of reach for the average blue-collar American.

If you are in the blue-collar category, don’t give up hope. There are a few ways to put a plot in wiathout spending a small fortune. To plant a plot, you need lots of seed. Most seed blends only cover an acre or two of land. If you plan on planting a large section of field, you may need multiple bags of seed. The first cost-cutting method is to save money when purchasing seed. Consider purchasing seed from a local seed company rather than a nationally known seed company. Many of the national companies have great ads and flashy seed bags but that is often the only difference between the quality of their seed and the quality of the seed from your local farm store. Buying generic seed from a local farm supply store can save as much as 50% on the price of seed.

In the North Country, many seed companies sell seed blends that are designed specifically for the North Country. Many of the national blends available were designed to flourish in southern climates where the temperatures are much warmer than they are in Michigan, Wisconsin, and Minnesota. If you live up north and plant a blend designed for the south, you might find that you have to replant the plot every year because the cold winters killed the seed. One way to reduce the cost of plots is reduce the number of times you plant. Finding a seed that is designed to flourish in your neck of the woods is one way to do that.

Planting a perennial instead of an annual is another way to save money. Clover is the most popular perennial on the market. Finding clover seed at a local farm store is easy and inexpensive. Most clover blends are meant to last a few years and with proper care, they will. This means less planting which results in less seed, less lime, and less time spent in the field working. If you want to save time and money, you may want to consider buying a new clover seed on the market - Lucky Buck Perfect Perennial. Although the upfront cost of the clover blend may be more than other brands, it offers several advantages. It lasts up to six years, which is two to three times longer than most clover blends on the market and will save you time and money. There are a few varieties of clover in the blend that mature at different rates, so a new clover is constantly maturing, giving whitetails something new to eat all the time.


If buying a plot machine is out of the question and you have a strong work ethic, consider a food plot seed blend designed to be planted without using heavy machinery. A rake and some weed killer are the only requirements. Below is a list of some seed blends for the guy who has a $10 rake, not a $10,000 ATV and plot machine. Many of these seed blends that don’t require heavy equipment are only made by national companies, so the seed will cost more than seed blends you would find at the local feed store. However, it’s still cheaper than buying an ATV.

Imperial, a seed company that has been around for years, has an annual seed blend called No-Plow. This blend is readily available at Bass Pro Shops and other national sporting goods chains. No-Plow consists of clover, grasses, and canola that will attract deer, turkeys, and a variety of other game animals. This product is great because plowing is not required. Simply kill the weeds in the area you want to plant with a weed killer, rake the soil, and plant. If your soil is extremely acidic, some lime will be needed before planting. Adding fertilizer before seeding will also help.

Biologic, one of the best-known names in the food plot arena has a blend called Hot Spot. The Hot Spot blend is designed to be planted without tilling. Hot Spot is a blend of buckwheat and winter peas. One bag is meant to be planted in a 20x20 area and sprouts quickly if lime and fertilizer are spread first. If they are not added, the plot will still grow, just not as quickly. The no-tilling blends are designed to be heartier than your typical seed blends and don’t require as much care or water in most cases.

Frigid Forage Food Plots of Northern Minnesota makes an easy-to-plant food plot called Autumn Quick Plot. I’ve had the opportunity to hunt over this blend and was extremely impressed with its’ ability to grow anywhere. I hunted over it in West Virginia. The blend was planted on a remote two track a few weeks before I arrived to hunt. It received very little water, yet it was lush and green. The Quick Plot only takes a few weeks to start growing and is perfect for the hunter who wants a nice plot close to a remote treestand. The Quick Plot has a variety of things in it including Winter Rye, Hairy Vetch, Winter Peas, and Dwarf Rapeseed. You can plant a small Quick Plot for under $20.

If you want to plant a large plot that will require the use of an ATV or a tractor and a plot machine but don’t want to fork out the cash it takes to purchase the equipment, try to find a farm store or sporting goods store that rents the equipment needed to plant a food plot. If you decide to take this route and have a few friends who might also want to plant a plot, you can split the cost of a rental to bring down the cost of the plot. This also goes for the seed. Buying it in bulk and splitting it with a few friends is a great way to save a few dollars.

Even if you have money to burn and want to plant enormous plots that will be limed and watered regularly, you may want to consider planting one of the seed blends discussed above. The biggest problem with most food plots is they require a lot of care after they’re planted. If they don’t get enough sun, they die. If they don’t get enough water, they die. If the soil isn’t just right, they die. Do you see the pattern? Food plots can be difficult to grow. The blends discussed are meant to be planted in remote locations where controlling the sun and water the plot gets can be difficult to control. These hardy blends are perfect for anyone that is short on time or who has a brown thumb (like me).

Most of these seed blends sprout extremely quickly. If time gets away from you this summer and you don’t have time to plant a plot, some of the seed blends listed above can still be ready by next hunting season. If you plant it in September, you can hunt over it in October and November. Or, if you plant a plot and it dies out for some reason before hunting season, many of the blends will work great as a last-minute backup plan.

Food plots can be fun, but they can also cost a lot of money. If you don’t have a lot in the bank but want to experience harvesting a whitetail over a food plot, try some of these suggestions and you may find yourself hunting over a food plot this fall.

29 year old Pro rider Paul Smith has been one of the most dominant riders on the east coast in the last few years. ‘Smithy’ will contest the remaining rounds of the QRCV Tri State Series, most of the QRCV Super Series 8 and the Australian ATV Nationals in MX racing. Smith will be competing on the all new DS450X a revolutionary new ATV that has the industry talking, and for the Australian Safari he will be competing on the Renegade 800X.

Smith said “This is all very exiting. Can-Am have really stepped up to the plate this year. I am looking forward to building a relationship with a company that wants to grow our sport. We’re looking good from the start because the DS450X is a fantastic platform to start from. My main focus is on Finke at the moment and Can-Am riders are in a good position to do well up there. Between my good mate Rick Beer (a multiple Finke winner) and I, we hope to put Can-Am on top of the podium. We have about 4 or 5 other riders who are going to be right up the pointy end also.

Team Bullet will be squarely aimed at lifting brand awareness by competing on everything from the awesome Renegade 800 right through to the mini DS90X.

We were asked us to rename a consumer brand of scooters, ATV and mini-motorcycles.

We asked what would give the brand personality. Something hip for the scooter culture and tough enough for the off road types.

We started with what their products do and what attributes are important to the customer. Then delved into heritage of the two and four wheel worlds. Words like motor bike, durability and mobility were blended together to arrive at Moduro. Which just happens to mean “motor” in Welsh.

There are many different ways that people like to travel. From walking to running to driving are just a few methods of transportation that we employ. In the area of driving there are many types of vehicles that are used, with cars and motorcycles being the more popular type. There are however some people who like to use the ATV 4 wheelers for their traveling needs.

These items put together help to make ATV 4 wheelers capable of being adapted into whatever area of work that it is put to. For instance while the Honda ATVs are known for their sturdy workman ability, the Polaris ATV is dubbed as being the toughest ATV in the world.


This ATV has the ability of going through rough terrain that other ATV 4 wheelers might have trouble with. For instance there is no problem for the Polaris to drive through muddy or swampy type ground without causing its driver any steering difficulties. Head injury killed McClellanville teen after ATV f

MCCLELLANVILLE — A teenager killed while riding an all-terrain vehicle early Sunday had tried to drive up an embankment and lost control, the Charleston County Sheriff's Office said.

The Coroner's Office said Joshua Thomas, 17, died of head injuries in the 2 a.m. incident.

The Sheriff's Office said Thomas was riding a Yamaha Big Bear on the dikes off Old Cemetery Road near S.C. Highway 45.

"The ATV rolled back, he fell off and ATV fell on top of him," sheriff's Maj. John Clark said.

On April 7 last year, an 8-year-old girl was killed in an ATV accident at McClellanville Baptist Church Cemetery, in the same general area.

Oriana Small was riding an all-terrain vehicle with a 14-year-old girl. They crashed, and the vehicle fell into a drainage ditch with water in it. Authorities said that the younger girl was not breathing when rescuers pulled her from the ditch and that she died at a hospital about two hours later.

South Carolina lawmakers passed a law last year that would have required children ages 6 to 15 to complete an ATV safety course and wear a helmet and eye protection while riding. But Gov. Mark Sanford vetoed it. The law would have banned children age 5 and younger from operating the popular off-road vehicles.

The U.S. Consumer Product Safety Commission recorded 13 deaths from ATV accidents in South Carolina from 2002 through 2005. The Commission recorded 555 ATV-related deaths in the United States in 2006. Most happened when the vehicles overturned.
