Man charged in ATV-related death appears in court

MARSHALL — Cory Lee Buchert, 30, of Russell, the man charged in the September death of Nichole Rathje, 27, of Marshall appeared in Lyon County District Court on Monday.

Buchert is charged with manslaughter in the second degree and two counts of criminal vehicular homicide. Buchert was driving an all-terrain vehicle while impaired and in an accident which injured Rathje on Sept. 3 in Lyon County, the complaint alleges.

Buchert did not call an ambulance or seek medical help for Rathje after two ATV accidents, the complaint alleges. Buchert placed her on the back of the ATV after the first accident where she was injured and then while driving the ATV, Buchert was in a second accident, the complaint alleges.

Buchert again placed Rathje on the back of the ATV and when the ATV quit, he dragged Rathje and left her outside of his house in Russell for several hours while he showered, washed clothes and slept, the complaint alleges. Buchert woke up and found Rathje dead outside his house several hours later, the complaint alleges.

Buchert said to law enforcement he thought Rathje would be OK and that they talked outside his house before he went inside, the complaint alleges.

In court on Monday, Buchert and his lawyer Jim Flemming requested a pre-trial hearing to be held before an omnibus hearing. Buchert waived his court time line.

A pre-trial hearing was set for April 25.

Buchert is the third person to be charged with criminal vehicular homicide in less than a month in Lyon County. Olga Franco, also known as Alianiss N. Morales, 23, of Minneota, was charged with four counts of criminal vehicular homicide in the death of four Lakeview School students killed in a Feb. 19 school bus crash. Franco drove a van which struck the bus and she did not stop for a stop sign, the complaint alleges.

Franco did not have a license and is an illegal immigrant from Guatemala, Immigration and Customs Exchange officials have said.

David Christopher Breyfogle, 32, of Taunton was charged with two counts of criminal vehicular homicide and one count of driving after cancelation-inimical to public safety in the Feb. 29 hit-and-run death of Norma Traen, 72, of Taunton.

Breyfogle was driving with a canceled driver’s license and struck Traen, who was walking along Lyon County Road 1, and Breyfogle did not stop or report the crash, the complaint alleges.

The complaint for Breyfogle also alleges he was impaired with alcohol.

Each ATV tour on Kauai includes different sights, so make sure you look at what each company is offering to make sure you’re going to get what you want out of it. Some of the destinations included on the various tours include former sugar cane plantations, rain forests with secluded waterfalls, working cattle ranches and points along beautiful valleys. Generally speaking, the tours last several hours and include a meal or snacks in the price of the ticket.


You’re likely to get muddy - this is the wettest Hawaiian island, after all - so dress appropriately. And because your hands will be preoccupied with driving the vehicle, you’re probably not going to be able to be snapping photos along the way. Check with the tour companies before you leave - many will take digital photos during your tour which you can buy at the end of the trip.

A couple of the ATV tour companies on Kauai are Kauai ATV and Kipu Ranch Adventures, and this growing trend should see even more companies offering ATV tours in the near future.

Please note: ATV tours are not advised for pregnant women or people who have back problems. You must be age 16 or over to operate an ATV, and you must be over the age of 5 to be a passenger in one of the multi-person dune buggies.

The ATV driver killed in an accident Monday in Coal City has been identified as James Douglas Walz, 19, of Coal City.

A 13-year-old passenger on the ATV remained in critical condition at Charleston Area Medical Center, Raleigh County Sheriff’s Capt. Gordon Gregory said.

The two were riding on a Honda ATV on Coal City Road about 5:25 p.m. Monday when the driver exited the roadway, lost control of the vehicle and struck a utility pole. Both riders were ejected from the ATV. The vehicle came to rest when it struck a parked U-Haul truck.

Wisconsin DNR Secretary Matt Frank is recommending against the development of ANY ATV trails in the Northern Highland-American Legion State Forest.

In a memo to the Natural Resources Board released this afternoon, Frank said his reasons included:

? the negative impact ATV trails would have on many of the 2 million nonmotorized NH-AL visitors every year,

? the “very strong opposition to ATVs on public land,” particularly in Vilas County,

? “the potential for adverse ecological impact” from ATV trail development,

? and the high cost of ATV trail development, on-going maintenence and law enforcement.

Frank’s recommendation comes in advance of the April 23 meeting of the Natural Resources Board (NRB), at which a final decision will be made whether to permit ATV trails in the NH-AL.

The Frank memo is an excellent sign that common sense and good public land management will prevail. And the recommendation was not unexpected by anyone that read Frank’s February memo, discussed here.

No one should assume, however, that the NRB will agree with Frank and vote to prohibit ATVs in the NH-AL. Chances are they will, but I, for one, won’t plan to attend any parties until after the votes are cast and counted.

As stated in an email by Sue Drum, a leading opponent of ATVs in the NH-AL, “Now we need people, more than ever, to come to Madison for the April 23 meeting to show the NRB that this recommendation has many supporters. When we are winning, it is not the time to pull back.”

In order to speak at the meeting on the 23rd, you must call NRB liasion Laurie Ross at 608/267-7420 by this Friday, April 18, at 4 p.m. Testimony will likely begin at 1:15 p.m., according to the NRB meeting agenda.
